Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the website operated by Sol Media ("Sol Media," "we," "us," or "our") at solmedia.com and your purchase of any real estate photography, video, or related services from us. By booking a session, paying for a package, or otherwise engaging Sol Media, you ("Client" or "you") agree to be bound by these Terms.

If you are booking on behalf of a brokerage, agency, or other entity, you represent that you are authorized to bind that entity to these Terms.

Sol Media offers real estate photography and cinematic video services for residential properties in Utah Valley. Specific deliverables, session length, and pricing are described on our website and at the time of booking. The two current packages are:

• Essential ($150). Twenty-five to forty professionally edited photos, twenty-four-hour turnaround, private online gallery, approximately forty-five minutes on site.
• Signature ($180). Thirty to fifty professionally edited photos, one cinematic walkthrough video (vertical or horizontal), twenty-four-hour turnaround, private online gallery, approximately forty-five minutes to one hour on site.

We reserve the right to modify, suspend, or discontinue any package or service at any time. Changes will not apply to bookings already paid for.

All bookings are made through our online scheduling system. A fifty percent (50%) deposit is due at the time of booking, which confirms your slot on our calendar. The remaining fifty percent (50%) is due on delivery, before or at the time the finished gallery is made available. Sol Media may withhold delivery of the gallery until the balance is paid in full. Prices are in U.S. dollars and exclude any applicable taxes, which will be added at checkout where required.

If a payment is declined, reversed, or charged back, your booking is not confirmed and we may decline or cancel the session without further notice.

Real estate photography depends on usable lighting and weather for exteriors. If conditions before or during a scheduled shoot would, in our judgment, materially affect exterior images, we will reach out to reschedule or to shoot interiors as planned and return for exteriors at no extra charge. Weather-related rescheduling is always free, no matter when. We are not responsible for changes in weather forecasts after a session is completed.

You are responsible for ensuring that the property is accessible and ready for photography at the scheduled start time. This includes:

• Providing access (lockbox code, door code, agent entry, or an on-site contact) in advance.
• Turning on all lights and opening blinds and curtains.
• Removing personal items, clutter, trash, cleaning supplies, and similar visible obstructions.
• Making beds, clearing surfaces, and securing pets.
• Confirming any permissions required for photographing the property, including from the property owner if you are not the owner.

Sol Media is not a staging or cleaning service. We do not move or relocate furniture or personal belongings. If a property is not ready at the scheduled time, we will photograph the property in its current condition. Returning to re-shoot an unprepared property may be charged as a new session.

If we are unable to access the property at the scheduled time due to no fault of ours, the session is forfeited and a new booking is required.

Composition, angles, lighting, framing, and editing choices are made at the professional discretion of the photographer. Specific shot requests should be communicated before or at the start of the session. We will reasonably accommodate requests but make no guarantee that every specific shot will be produced.

Edited photos and the Signature cinematic video are delivered through a private online gallery within twenty-four hours of the session, in most cases. You will receive a link to the gallery by email. From the gallery you can download high-resolution files for MLS, web-sized files for social media, and share the gallery link with sellers, co-agents, or your team.

Galleries remain available for at least one year from delivery. After that time the gallery may be archived. You are responsible for downloading and backing up your files.

This section is important. Please read it carefully.

You represent and warrant that you have the legal right to authorize photography of the property, including any permissions required from the property owner. You are responsible for notifying any occupants of the photography in advance and for the privacy of personal items left in view. Sol Media is not responsible for personal property visible in delivered images.

To the maximum extent permitted by law, Sol Media's total cumulative liability arising out of or relating to your use of our services or these Terms shall not exceed the amount you paid Sol Media for the specific session that gave rise to the claim.

Sol Media shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of a sale, loss of business opportunity, or loss of goodwill, even if Sol Media has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

You agree to indemnify, defend, and hold harmless Sol Media and its owners, employees, and contractors from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your breach of these Terms.
• Your unauthorized use of the Media or any breach of the license granted in Section 9.
• Any claim that you did not have the right to authorize photography of the property.
• Any injury to persons or damage to property occurring at the property during a session, except to the extent caused by Sol Media's gross negligence or willful misconduct.

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or our services shall be brought exclusively in the state or federal courts located in Utah County, Utah, and you consent to the personal jurisdiction of those courts.

Before filing any formal action, the parties agree to attempt to resolve the dispute informally by contacting solmediautah@gmail.com. If the dispute is not resolved within thirty days, either party may pursue formal remedies.

Sol Media is not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, severe weather, natural disasters, illness, government action, power or internet outages, or third-party platform failures (including our scheduling, gallery, or payment providers).

We may revise these Terms at any time by updating this page. The revised Terms apply to bookings made after the revision date. Bookings already confirmed are governed by the Terms in effect at the time of booking, unless we obtain your express agreement to the updated Terms.

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with any specific terms presented at the time of booking and our Privacy Policy, constitute the entire agreement between you and Sol Media regarding our services.
